Terms & Conditions
GENERAL
Any order accepted by Premium Tile and Mosaic Outlet Pty. Ltd. (The Company) whether or not it is based on or results from a price list or quotation given by the company is deemed to incorporate these terms of conditions; no variation or modification of or substitution for these terms or conditions shall be binding unless specifically accepted by the Company in writing.
ORDERING, QUOTATIONS & PRICES
Unless previously amended or withdrawn, any Company’s quotation are open for acceptance for the period of 30 days after the date thereof. Prices provided, unless otherwise stated, are inclusive of GST and do not include free delivery.
Additional delivery cost will apply based on delivery requirements. The Company reserves the absolute right at any time to alter any of its selling prices and to alter terms to any Customer (The Customer) without any notice whatsoever. The Company will make every effort to advise or notify the Customer of any alteration of selling prices within a reasonable time.
TERMS OF PAYMENT
Subject to any terms agreed between the Company and the Customer, the terms of payment are as follows:
a) In store payment can be made by cash, EFTPOS, credit cards (Visa and MasterCard only).
b) Payment via EFT or cheques are also accepted, however orders will not be processed until the funds are cleared.
c) Online order payment is via PayPal (Master Card, Visa Card or cards that are accepted by PayPal).
RETENTION OF TITLE
Irrespective of any credit arrangement between the Company and the Customer the following provision will apply:
a) Property of the Goods sold by the Company will pass to the Customer only after full payment of these Goods received
b) Until the Goods have been paid in full:
I. The Customer agrees that the Company at any time to enter and reclaim the Goods from any premises owned or occupied or used for storage by the Customer.
II. Any marketing merchandise, e.g. samples, brochures ect., offered at no costs to the customer will remain Premium Tile and Mosaic Outlet’s property at all times.
LIMITED LIABILITY
All Products (the Goods) to be checked prior to any installation. No claim will be considered once the products have been installed. The company liability is limited to the Goods supplied only. The company will not accept any liability for installation of faulty or incorrect product or inappropriate usage of any Goods supplied or any consequential losses deriving from these. We cannot guarantee that the appearance and/or colour of the Products shown or obtained as sample exactly reproduces the appearance and/or colour of the physical Product supplied. Variation in shade and structure are inherent in all kiln-fired products and Natural Stone products. From time of collection from Premium Tile and Mosaic Outlet warehouse or delivery to the nominated place by the Customer, the Goods shall be at the risk of the Customer and any loss of or damage to or deterioration of the goods from any cause whatsoever other than negligence of the Company shall be the responsibility of and be borne by the Customer.
WARRANTY
All goods are sold “AS-IS”. Seller disclaims any implied warranty of merchant ability or fit for purpose or use. Due to the wide application use of our products, it is the Customer’s duty to purchase the correct product for the correct use. Any incorrect use of the Product is solely to the Customer responsibility. The Company accepts no liability for any loss, damage or injury arising as consequence of any advice provided and makes no warranty or representation as to the satisfactory quality or fitness for a particular purpose of our goods.
DELIVERY
The Order must clearly include the delivery address (except for pickup orders), contact details, specific conditions, instruction or non-standard procedure required. The Company will not undertake any delivery until full order payment received. The Company will do all that is reasonably possible to meet the required or given date for delivery but the date is to be considered purely indicative and not binding. The Company has no control on failure of delivery caused by third parties such as Drivers or Transport contractors.
All paid orders that are required to be kept in Premium Tile and Mosaic Outlet prior to final delivery/collection will be subject to a maximum of 2 weeks free storage after which, a storage fee of $15.00/pallet or $0.5/box per week will apply. The Customer must pay for all storage fee before the order is delivered or picked up. Purchased goods will not be released until storage fee is cleared.
RETURNED AND DAMAGED GOODS
If the Product you have purchased is faulty, we may offer an exchange or refund as appropriate and in accordance to the Customer preference. Quantity and quality must be checked on arrival or pick-up. Any discrepancy should be reported immediately within 24 hours. No claims after goods installation.
All products purchased at Premium Tile and Mosaic Outlet are priced for clearance; Unless it is approved by Premium Tile and Mosaic Outlet, no returned goods or cancellations of paid orders will be accepted due to change of mind. Premium Tile and Mosaic Outlet will only offer exchange for change of mind purchases within seven days of the transaction, which is also subject to 30% handling fee of the value of the original purchase. Proof of the original purchase (tax invoice, delivery docket, bank statement etc.) is required for any exchange transaction. The Customer must send back the purchased goods at his own cost, in resalable condition and in the original packaging. Ceramic and porcelain tiles must be returned in full boxes only. Products which are ordered on an Indent basis or are made or cut to the Customer requirements cannot be exchanged.
Customer must obtain a written confirmation from The Company before sending the goods back for exchange. Premium Tile and Mosaic Outlet reserves the right to refuse the return of goods if conflicts or outdates current stock volumes or batches.
